General

1.    Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

2.    To the extent of any inconsistency between these Terms and Conditions and any other reference to this competition, these Terms and Conditions prevail.

Who can enter

3.    Entry is only open to New Zealand residents aged 18 or over. Employees (and their immediate families) of the Promoter, participating retailers and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin (“Eligible Entrant”).

4.    The Promoter is Hempel (Wattyl) New Zealand Limited (NZBN 9429040733692), 2-14 Patiki Road, Avondale, Auckland, New Zealand.

How to enter

5.    During the Promotional Period the Promoter will use its Facebook @wattylpaintnz and Instagram account @wattylpaintnz to publish various posts asking people to visit facebook.com/wattylpaintnz or instagram.com/wattylpaintnz, search for the relevant post and to comment on the post (as applicable) (‘Post’).

6.    To enter you must: Ensure you

a.    ‘Like’ or ‘Follow’ Wattyl Paint on Facebook or Instagram and continue to ‘Follow’ it until the winner is announced if the entry is on Instagram; and

b.    Find the post on either Facebook or Instagram

c.     On the Post: Tag a friend and answer the question posted in the comments

d.    For a bonus entry: Share competition post either on IG or FB (ensure this is set to ‘public’)

7.    There is a limit of one valid entry per person.

8.    The Promoter reserves the right, in its sole discretion, to reject any entries which do not comply with these Terms and Conditions and will not provide any reasons for rejection. Entries that do not comply with these Terms and Conditions of entry will be deemed invalid and are not eligible to win a prize.

9.    This promotion is in no way sponsored, endorsed or administered by, or associated with, Instagram and Facebook. Instagram and Facebook membership and the use of Instagram and Facebook generally are subject to the Instagram and Facebook prevailing terms and conditions of use available at instagram.com and facebook.com. Entrants are solely responsible and liable for the content of their entries and any other information they transmit to other internet users via Instagram and Facebook. To the extent permitted by law, each entrant agrees to indemnify, defend and forever hold harmless, Instagram and Facebook and associated agencies and companies, against any and all losses, actions, claims, costs, expenses and damages (of any nature) which may be incurred by an entrant in respect of the entrant’s participation in the promotion. Any questions, comments or complaints about this promotion must be directed to the Promoter and not to Instagram and Facebook. The Promoter reserves the right to moderate or remove any entry deemed inappropriate or in breach of these Terms.

Open, Close, Draw and Publish dates

 

10.  Promotion commences on 24/07/2025. Final entries must be received online by 11.59pm NZDT on 31/07/2025 (“Promotional Period”).

11.  No entries will be accepted after the promotion closes. Entries are deemed to be received at the time they appear on the associated post.

12.  There will be one (1) draw at the end of the promotion. The Winner will be drawn on 01/08/2025 at 11am NZDT at the Promoter’s Office. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. The first entry drawn will be deemed a Winner and will be contacted via direct message on the associated platform on the day of the draw 01/08/2028. If the winner does not respond within 48 hours of being contacted, and reasonable efforts have been made by the Promoter to reach them, the prize will be reallocated to another valid entry.

13.  The Winner will be published at win.wattyl.co.nz from 04/08/2025. The Winner may be displayed on Wattyl’s Facebook and Instagram stories.

14.  The Promoter may, in its absolute discretion, select a replacement winner from the valid entries in the event that an invalid entry or ineligible entrant is drawn. The Promoter reserves the right to conduct a redraw in the event that an entrant, claiming to be a winner, is unable to satisfy these Terms and Conditions or has breached these Terms and Conditions.

 

Prize

 

15.  Each winner will receive the following Prize:

a.    Prize is for the Winner and a companion (guest must be aged 12+)

b.    Return economy flights from the winner’s nearest Regional City (Auckland, Christchurch or Wellington) to Sydney Australia, on 08/08/25 and returning on 10/08/25.

c.     Transfers Sydney airport/hotel/ Sydney airport.

d.    2 nights accommodation at Pullman Sydney Olympic Park hotel (5 stars; Superior room, check in 08/08/25, check out 10/08/25), with breakfast daily

e.    2 x centreline seat tickets to Bulldogs vs Warriors at Accor Stadium, Sydney Olympic Park on 09/08/25

f.      A gift pack containing Wattyl merchandise to be collected at hotel check-in. All dates and events are in times based on the location the activity is occurring.  All winners will be attending the same events together. There is no flexibility on dates.

Total Prize RRP is valued at up to NZD $3850 (including GST) depending on place of departure.

16.  The Winner must be able to travel on the specified dates and provide at own expense a valid and current passport (6 month validity). In the event the Winner drawn is unable to fly from New Zealand to Australia on the requested dates, the Promoter will select a replacement Winner. 

17.  If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

18.  Where relevant and flights and/or accommodation forms part of a prize, spending money, meals, taxes (excluding airline and airport taxes), insurance, transport to and from departure point, additional transfers (other than those specified), items of a personal nature, in-room charges and all other ancillary costs are not included. Each winner must depart from and return to the same departure point. Itinerary to be determined by the Promoter in its absolute discretion. Frequent flyer points will not form part of the prize. Winners may be required to present their credit card at time of accommodation check in. All accommodation and flights are to be booked by 06/08/25. The Winner must use the Promoter’s preferred supplier.

19.  For all winners, any ancillary costs associated with getting to and from their local Regional airport will not be included and will be the responsibility of the winner.

20.  Any costs associated with the enjoyment of the prize are the responsibility of the winner. The Prize is subject to the event venue/s and ticket terms and conditions, including any applicable clothing requirements. The Promoter and associated organisers and suppliers hereby expressly reserve the right to eject the winner for any activities for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the Prize. The winner of the Prize is responsible for any further costs associated with redeeming the Prize which are not otherwise specified in these Conditions, including but not limited to, any additional travel costs, spending money, travel insurance, food and beverage expenses, additional entertainment and/or miscellaneous expenses or other incidentals. For the avoidance of doubt, no “spending money” is included as part of the Prize.

21.  Prize is non-transferable and cannot be exchanged for cash.

22.  Prize values are based upon the recommended retail prices at the time of printing (inclusive of GST). The Promoter accepts no responsibility for change in prize value between now and the ultimate prize redemption date.

23.  If for any reason a winner does not take a prize (or an element of a prize) by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited and will not be redeemable for cash.

 

Further Terms and Conditions

 

24.  Entrants may only enter in their own name. Inaudible, incomprehensible, illegible, and incomplete entries may be deemed invalid. Only those entries received by the Promoter will be included in the competition draw.

25.  Any entrant found to have used a third party (including online competition entry site) to enter on their behalf will have all entries invalidated and any claim they have to any prize will be invalidated. If such an entrant is awarded a prize and then found to have breached this clause, the entrant must immediately return any prize awarded. The Promoter has sole discretion to determine if this clause has been breached by any entrant. The Promoter reserves the right to request whatever documentation it deems necessary to confirm if the entrant has breached this clause. An entrant must provide any requested documentation to the Promoter upon request. The Promoter reserves the right to disqualify any entrant who provides false information or who seeks to gain an unfair advantage or to manipulate this competition.

26.  The Promoter reserves the right, in its sole discretion, to reject any entries which do not comply with these Terms and Conditions and will not provide any reasons for rejection. Entries that do not comply with these Terms and Conditions of entry will be deemed invalid and are not eligible to win a prize.

27.  The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

28.  The Promoter highly recommends a current residential street address be provided when requested for ease of correspondence and potential prize delivery. The Promoter makes all reasonable efforts to deliver prizes to the addresses provided by competition entrants. The Promoter cannot guarantee that any prizes returned to the Promoter due to non-delivery at the provided address will be re-sent to the prize winner.

29.  The Promoter reserves the right to request winners to sign a winner’s deed of release (and indemnification) or any other relevant forms or agreements that the Promoter deems necessary, to provide proof of identity, proof of age, proof of residency at the nominated prize delivery address and/or proof of entry validity (including phone bill) in order to claim a prize. Proof of identification, residency, age and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.

30.  The Promoter’s decision in relation to any aspect of the competition is subject to State and Territory legislation but also final and binding on each person who enters. No correspondence will be entered into. No responsibility is accepted for late, lost or misdirected entries. Prizes are subject to availability, not transferable or exchangeable and, with the exception of cash prizes, cannot be taken as cash. The Promoter and their associated agencies, and companies associated with this promotion will take no responsibility for prizes damaged or lost in transit.

31.  All entries and any copyright subsisting in the entries become and remain the property of the Promoter who may publish or cause to be published any of the entries received.

32.  In participating in the prizes, the winner/s agree to participate and co-operate as required in all editorial activities relating to the Competition, including but not limited to being interviewed and photographed. The winners (and their companions) agree to granting the Promoter a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide, including online social networking sites, and the winners (and their companions) will not be entitled to any fee for such use.

33.  Prize-winners are advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of that prize.

34.  The Promoter (subject to legislation) reserves the right to amend, cancel or suspend this competition if an event beyond the control of the Promoter corrupts or affect the administration security, fairness, integrity or proper conduct of this competition. The Promoter will disqualify any individual who has tampered with the entry process or any other aspect of this competition. In particular, computer generated entries and the use “scripting” is not permitted and will not be accepted.

35.  Any cost associated with accessing the promotion is the entrant’s responsibility and is dependent on the Internet service provider used.

36.  Nothing in these Terms and Conditions limit, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees, as well as any other implied warranties or consumer protection laws in New Zealand (‘Non-Excludable Guarantees‘).

37.  Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or Entrant; or (f) use of a prize The Promoter (including its’ officers, employees and agents) excludes all liability for any loss (including, without limitation, indirect, special or consequential loss or loss of profits or opportunity), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this competition including taking or using a prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law), including the Non-Excludable guarantees. Any change in value of the prize occurring between the publishing date and date the prize is claimed is not the responsibility of the Promoter.

38.   The Promoter collects personal information (“PI”) in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://www.wattyl.co.nz/privacy-policy/. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. The Promoter complies with the privacy principles set out in the New Zealand Privacy Act 2020. All entries become the property of the Promoter. The Promoter will not disclose entrant’s personal information to any entity outside of Australia and New Zealand.

Prizes:

  1. 61 supermarket vouchers valued at $250.00 inc gst to be won every day from 1st October to 30th November 2024 (“Prize”).
  2. No portion of the prize is redeemable for cash. The prize is non-refundable and non-transferable.
  3. Should circumstances beyond the Promoter’s control arise, the prize may be altered, and the Winner awarded a prize equal or higher in value to the Prize.
  4. Your voucher can be redeemed for goods and services from the respective supermarket up to the value loaded onto your voucher. Value redeemed is deducted from the card balance.
  5. Your use of the voucher at the respective supermarket is subject at all times to the policies (and, where applicable, other terms and conditions) of that store regarding the goods and services made available by it and to compliance with law.
  6. Where the price of the goods or services being purchased with the voucher exceeds the card balance, you must pay the amount exceeding the card balance by an alternative payment method at the discretion of the relevant store.
  7. Once your voucher has reached a nil balance it cannot be re-activated.

Prize Draws:

  1. One Prize to be drawn every day from Tuesday 1st October to Saturday 30th November 2024.
  2. The Promoter’s decision is final, and no correspondence will be entered in to.
  3. The Winners will be notified by telephone on the day of each draw.
  4. All winners will receive their voucher via email.

General Terms and Conditions of Entry:

  1. Information on how to enter form part of these Terms and Conditions of Entry. Participation in this Promotion is deemed acceptance of these Terms and Conditions.
  2. This Promotion is only open to “Eligible Entrants”, being individuals who: (i) are residents of New Zealand aged 18 years or older; and (ii) are not employees of the Promoter or Wattyl Retailer or their immediate families and (iii) are not professionally connected with the Promotion.
  3. The Promoter’s decision is final and no correspondence will be entered into.
  4. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for death or any personal injury suffered or sustained as consequence participation in the promotion.
  5. Except for any liability that cannot be excluded by law, the Promoter (including its officers, directors, shareholders, employees, advisors, assignees, agents, licensees, representatives, advertising and promotional agencies) excludes all liability (including negligence), for any personal injury or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where attributable to any of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions of Entry; (e) any tax liability incurred by a claimant or entrant.
  6. The Promoter reserves the right to cancel or amend this Promotion due to events arising beyond its control.
  7. The Promoter is not responsible for any third-party acts or omissions.
  8. The Promoter reserves the right to amend or modify these Terms and Conditions of Entry at any time and from time to time.
